Legal Issues for Same Sex Couples in Pennsylvania: The New Normal


Attorney Kathleen D. Schneider provides detailed insight into the impact of the recent changes in the LGBT legal landscape, including the U.S. Supreme Court's@@@MoreBegin@@@June 2013 Windsor decision and the May 2014 Pennsylvania Court's Whitewood case. Focusing on practical tips for probate and trust practitioners, Ms. Schneider addresses estate planning for the new LGBT world, including changes in federal estate tax and Pennsylvania inheritance taxes, as well as real estate transfer taxes. Waypoints for New Litigators


From client engagement to pre-trial, this two hour session will feature practicing attorneys giving their views of best practices for the Allegheny County Court of Common Pleas. Discussion will include items that are essential in the initial engagement letter to comply with the rules, but also best practices in the engagement letter to reduce risk, the intricacies of motion practice in Allegheny County and a moderated discussion that will share views for effective pleadings, and discuss samples of forms ranging from the initial filing up to the pretrial statement. Participants will leave with a collection of forms that could be a valuable resource for a litigation practice, from client intake through the pretrial statement.

The goals of the Disciplinary Board of the Supreme Court of Pennsylvania are to maintain the integrity of the legal profession and safeguard the reputation of the courts. All individuals practicing law in Pennsylvania are subject to the board's oversight, meaning itis important for all attorneys to stay up-to-date on the board's rules and procedures. This CLE will review the purpose of the PA Disciplinary System, the application and enforcement of the PA Disciplinary rules, the forms of discipline and the resources available for Pennsylvania lawyers to ensure adherence to the rules. Review of recent “hot topic” disciplinary cases will also be discussed to illustrate the application and enforcement of discipline under the Pennsylvania Disciplinary Board.

Technology Competence Confidentiality and Risk Management


Today’s technology provides great benefits to attorneys, including productivity, efficient workflow, mobility, rapid – often instantaneous – communications, and unprecedented access to information. With these benefits, however, come great risks, particularly in the area of confidentiality. Recent amendments to the Pennsylvania rules of Professional Conduct require attorneys to be competent in technology and to take reasonable measures to safeguard confidentiality in using technology.
